Version 1.0, last updated: 2026-10-22
1.1 These terms apply to the purchase of access to the PM Career OS exam simulators on the subdomains of pm-career-os.de.
1.2 Your contracting party is Markus Kopko, PMotion.ai, Wildacker 41, 22523 Hamburg, Deutschland, email markus@pmcos.de (we, us). We answer questions about the simulators at support@pm-career-os.de.
1.3 Stripe processes payments. Stripe is a service provider and not a party to the contract.
1.4 The membership terms apply to the membership. § 5 of the terms at pm-career-os.de applies to the money-back guarantee.
1.5 These terms apply to consumers and to businesses. Deviating terms of a business do not apply.
2.1 You buy access to one edition of a simulator, for example Essential, Advanced or Deluxe. The pricing page of the simulator and the checkout state the question pool, the number of full exams and the access period of each edition.
2.2 You need a free account in the simulator to buy. Your access period starts when you start your first exam or quiz, not at purchase.
2.3 You can move to a higher edition and then pay the price difference. You can also extend a running access by 15 or 30 days.
2.4 The simulators prepare you for exams. We do not award certifications and do not promise that you pass an exam. The money-back guarantee in § 5 of the terms stays unaffected.
2.5 The names of the certifications are marks of their owners, for example the Project Management Institute, Inc. PM Career OS is not affiliated with or endorsed by them.
3.1 The pricing page is not yet a binding offer. You make a binding offer when you click the order button in the Stripe checkout. The contract is concluded when we activate your access, usually right after payment.
3.2 The contract languages are German and English. We send you the contract text with these terms and the withdrawal notice by email with your purchase confirmation.
4.1 All prices are final prices in euros. Under § 19 UStG we charge no VAT (German small business rule).
4.2 You pay before your access starts. The checkout shows the available payment methods.
5.1 If you are a consumer, you have a statutory right of withdrawal. The withdrawal notice and the model withdrawal form are in the annex.
5.2 Your right of withdrawal expires as soon as we have activated your access, if you expressly agreed in the checkout beforehand that we start before the withdrawal period ends, and confirmed that you lose your right of withdrawal as a result. We confirm both in the purchase confirmation by email.
6.1 Your access is personal. Do not share it, and do not publish, sell or distribute questions, explanations or solutions outside the simulator.
6.2 Do not extract the simulator by automated means. In case of serious or repeated breaches we may block your access. Where reasonable, we warn you first.
7.1 We aim for high availability. We cannot promise uninterrupted access, in particular during maintenance or outages at Stripe, Supabase, Vercel or other providers.
7.2 We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation and limited to the typical, foreseeable damage. Essential obligations are those whose fulfilment makes the contract possible and on whose observance you may regularly rely.
7.3 Your statutory rights regarding defects in digital products under sections 327 et seq. BGB stay unaffected.
8.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection of the country you live in stays unaffected.
8.2 If you are a merchant, the venue is Hamburg.
8.3 If a provision is invalid, the others stay valid.
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Markus Kopko, PMotion.ai, Wildacker 41, 22523 Hamburg, Deutschland, email markus@pmcos.de) of your decision to withdraw from this contract by a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
Your right of withdrawal expires early once we have started to provide your access, after you expressly agreed that we start before the withdrawal period ends, confirmed your knowledge that you lose your right of withdrawal with the start of provision, and we have provided you with a confirmation of the contract containing these statements.
(Complete and return this form only if you wish to withdraw from the contract.)
